Answers for Investors

Get clarity on the most common questions about U.S. investor visa programs and our legal services.

The EB-5 is an immigrant visa that leads directly to a permanent Green Card, requiring an investment of $800,000 (TEA) or $1,050,000 (standard) and the creation of 10 full-time jobs. The E-2 is a non-immigrant visa available to treaty country nationals with no minimum investment requirement; it is renewable indefinitely but does not directly lead to a Green Card. Many investors start with an E-2 while pursuing an EB-5 concurrently.
Processing times vary depending on the applicant's country of origin and USCIS workload. Generally, the I-526E petition takes 12 to 36 months for initial approval. Following approval, consular processing or adjustment of status typically takes an additional 6 to 12 months. Our team works to expedite every stage and keeps you informed with regular updates throughout the process.
Yes. Both the EB-5 and E-2 visa programs extend benefits to your immediate family. For the EB-5, your spouse and unmarried children under 21 receive their own Green Cards as derivative beneficiaries. For the E-2, your spouse receives a dependent visa with work authorization, and children under 21 can attend school in the United States.
A Targeted Employment Area is a geographic region designated by USCIS that qualifies for the reduced $800,000 EB-5 investment threshold. TEAs include rural areas (outside metropolitan statistical areas with a population under 20,000) and areas with high unemployment (at least 150% of the national average). Under the EB-5 Reform and Integrity Act of 2022, TEA designations are now determined by the Department of Homeland Security rather than individual states.
For the EB-5 visa, if you invest through a USCIS-approved regional center, you take a passive investor role and are not required to manage the business day-to-day. For direct EB-5 investments, you must be involved in management or policy-making. The E-2 visa requires you to direct and develop the business, though you may hire managers to assist with operations. We help structure your role to satisfy visa requirements while respecting your preferences.
As with any investment, EB-5 investments carry financial risk. USCIS requires that the capital be "at risk," meaning there is no guaranteed return. Risks include project delays, failure to create the required jobs, and potential loss of invested capital. Our role is to conduct rigorous due diligence on projects and regional centers, review financial projections, assess developer track records, and ensure full compliance with USCIS requirements to mitigate these risks as much as possible.
Legal fees vary based on the complexity of your case, the visa category pursued, and the scope of services required. We provide a transparent fee structure during your initial paid consultation, with no hidden costs. Our fees typically cover case evaluation, petition preparation and filing, source of funds analysis, USCIS communications, and representation through approval. Contact us to schedule a consultation and receive a detailed fee estimate for your specific situation.
